Since the death penalty was reinstated in 1977, 35 offenders with mental retardation have been executed nationwide. Six offenders with mental retardation have been executed in Texas.

Jim Harrington director of the Texas Civil Rights Project estimates 68
inmates, or 15 percent of the 455 people on death row (June, 2002), could be considered mentally retarded under the Supreme Court ruling.
